RHOBH Stars Adrienne Maloof And Paul Nassif Reach Child Custody Agreement

Adrienne Maloof and her estranged husband, Dr. Paul Nassif, have reached an out-of-court child custody agreement, RadarOnline.com is exclusively reporting.
The Real Housewives of Beverly Hills couple has been engaged in a bitter battle over there three sons ever since splitting in August.

“Adrienne and Paul and their respective lawyers met all day on Friday with a mediator, and they were able to come to a custody agreement,” a source close to the situation tells us. “Paul had been requesting 50/50 custody arrangement, and he didn’t get those terms. The boys will be with Adrienne a majority of the time, with Paul being granted visitation, and there are layers of protection in the agreement to ensure the boys are in a safe environment.”
As we previously reported, Adrienne was granted a temporary restraining order against her plastic surgeon spouse over allegations of emotional and physical abuse that Paul allegedly inflicted on his family. Child protective services conducted an investigation into the allegations, and determined that Nassif didn’t physically or verbally abuse the children.

A hearing to make the restraining order long term “is still on the docket to be heard, and will likely proceed with Adrienne only seeking for it to cover her and won’t include the boys, as it initially had,” the source reveals. “Both Adrienne and Paul worked diligently to reach the custody agreement that was fair and was truly in the best interests of the children.”

‘Real Housewife’ Adrienne Maloof Hauled To Court Over Custody Dispute Of Three Sons

The Real Housewife of Beverly Hills star Adrienne Maloof and her estranged husband, Dr. Paul Nassif, will likely be back in court Tuesday morning over a nasty custody dispute involving their three sons, RadarOnline.com is exclusively reporting.
Nasiff was so upset about the dispute that he hauled Maloof to court last Friday in a desperate attempt to resolve it, but the judge was not able to hear the matter because he was involved in another trial.
“A custody dispute over the three boys has arisen, and Paul felt that the only way to get it dealt with was to go to court on an ex-parte (emergency) basis on Friday. The judge was in another trial and unable to hear the matter, even though Adrienne and Paul were at the courthouse all day with their respective lawyers. They holed up in the cafeteria all day attempting to mediate and settle the matter, but they were unable to come to an agreement,” a source close to Nassif exclusively tells RadarOnline.com.

“At this point, it appears that the only way this can be resolved is a decision by the judge. Paul and Adrienne are planning to be back at the courthouse with their lawyers on Tuesday morning, as the clerk told their lawyers that the judge would have time for them on Tuesday,” the insider added.
As we previously reported, Nassif filed for divorce from Adrienne last Monday, August 27, citing “irreconcilable differences.”
“This is turning out to be a very, very nasty divorce proceedings so far, and the fact that Paul and Adrienne had to go to court on an emergency basis this early in the proceedings isn’t a good sign,” the insider previously told us.

Maloof said on Twitter, “Looking forward to a great weekend! Celebrating my birthday and spending time with my boys… What is everyone doing? Nothing better then a long weekend of relaxing and hanging with my kids…”
According to Nassif’s divorce docs, he is seeking joint legal custody of their three sons, and physical custody of the kids “according to children’s best interest.”

Diana Ross will sign off on a new proposed custody agreement in which Michael Jackson‘s three children, Prince, Paris, and Blanket will have two guardians, their grandmother Katherine Jackson and TJ Jackson, son of Tito, RadarOnline.com is exclusively reporting.
“Diana has no qualms whatsoever about the new custody agreement, she only wants what is best for the children. Diana knows that the children are old enough to decide who they want to live with and she defers to what they want. While Diana hasn’t been a big part of their lives because she lives on the East Coast, she is very fond of them,” a source close to the situation tells RadarOnline.com exclusively.

Michael Jackson’s will stipulated that if his mother was unable to care for the children, Diana Ross was his next choice.
As RadarOnline.com previously reported, last week, Judge Mitchell Beckloff, stripped the Jackson family matriarch of her guardianship of the three children because no one could reach her for over a week. The judge said he made the ruling not because of any wrongdoing on Katherine’s behalf, but because she had been prevented from fulfilling her guardianship duties by an “intentional act from third parties.” Judge Beckloff told all parties while in court last week, that Diana Ross, and Debbie Rowe, mother of the two oldest children, needed to be provided notice of what was transpiring.

The children have been embroiled in a vicious family struggle for more than a week now as Randy, Jermaine and Janet Jackson battle over the late King of Pop’s will, which they claim is fake. Michael’s nephew TJ has been a constant presence in the children’s lives and their attorney stated in court that they had no objections to him being appointed temporary guardian.
On Friday, it was announced that Katherine and TJ Jackson, would be petitioning to become co-guardians of the kids. The paperwork is expected to be submitted this week and the judge will have to sign off the proposed agreement.

Katherine Jackson Home, ‘Devastated’ About Losing Custody, Says Her Kids Did Nothing Wrong

Katherine Jackson, before returning to the Jackson family’s compound in Calabasas, California early Thursday, said she was “devastated” about losing custody of her grandchildren, and that her adult children had not held her against her will at an Arizona resort for nearly two weeks.
Katherine said she spoke with her three grandchildren, Paris, Prince Michael and Blanket and reassured them she would be back at their family home soon. (Paris confirmed her return on a tweet early Thursday, writing: “grandma’s here! #thankyougod <33″).
The Jackson family matriarch — back in Los Angeles after 11 days — delivered the news from the Miraval Arizona Report & Spa in Tucson, Arizona via a videotaped statement to ABC News Wednesday in which no questions were allowed. Flanked by Janet, Jermaine, Rebbie and Rebbie’s daughter Stacy, Katherine read the statement from a piece of paper, occasionally losing her way.

“I am devastated that while I’ve been away, my grandchildren have been taken away from me, and I’m coming home,” said Katherine, 82. “There are rumors going around about me that I have been kidnapped and held against my will.
“I am here today to let everybody to know that I am fine,” Katherine said. “My children would never do a thing to me like that, holding me against my will — it’s very stupid for people to think that.”
Katherine — in an attempt to clear up some of the “lies” circulating throughout the controversy — said she was in Arizona for “short vacation and rest,” and that the reason she hadn’t called home was because she “just gave up [her] phone and [she] didn’t want to have any phone calls while [she] was here.”

The appearance came hours after Los Angeles Superior Court Judge Mitchell Beckloff temporarily revoked her guardianship of the three children, designating the task to Tito Jackson‘s son TJ, after Katherine’s 10-day long absence. In the hearing, the judge noted he didn’t feel Katherine was in the wrong in any way, but rather distracted by the “intentional acts of third parties.”

Katherine’s attorney Perry Sanders Jr. says he will meet with her on Thursday, and looks to have the court reinstate her as the primary guardian, noting he will contest any motion to have TJ installed as the permanent guardian of the three children.
Here is the full statement Katherine Jackson released to ABC News:
I am here today to let everybody know that I am fine and I am here with my children, and my children would never do a thing to me like that, holding me against my will. It’s very stupid for people to think that.
But anyway, I am devastated that while I’ve been away, that my children, my grandchildren, have been taken away from me, and I’m coming home to see about that, also.
So I spoke to my grandson, TJ, last night, that I left there to be in charge of my children — and I never leave home without leaving them with instructions of who to stay there with them, the nanny and all of them — and someone had let go the cook, the nanny, and also the housekeepers. I don’t know who did that but they don’t have that power and they shouldn’t have done it.
And now, the people are saying they are there with nothing to eat. I am sure they have something to eat but it’s probably not healthy because the cook is not there.
But since I have also been away, my guardianship, which I just said, my children, have been taken away from me, my guardianship has been taken away from me. And, but, I spoke to my grandson TJ and also I spoke to Prince and Paris last night and told him I would be home today and they’re waiting for me to come.
And I told him it wasn’t necessary for him to go down and sign for guardianship. … I don’t know who instructed him to do that — but that’s what, but he wanted me to come home before that happened, but the ruling in court today was about the guardianship and I think it was based on a bunch of lies, but I have a good idea who’s doing that and who’s behind that.
But I am grateful for my children that they saw that I needed rest and they wanted to take me away for a while, just a short vacation and rest up. But one thing I have to say … that I’m here at Miraval. They have taken good care of me and have made sure that I got the rest that I needed.
One reason I haven’t called is I just gave up my phone and I didn’t want to have any phone calls while I was here.
My assistant, Janice Smith, has been calling back home to see how things were going and she had been keeping in contact with my nephew, I mean my grandson, and he says everything is going fine. But I was still thinking about the children and I still worry about them, but they are fine.
Before I left, as I said, I put everything in order with the appropriate people to take care of my children for me and it’s really bad to hear that what’s going on at home, and the children have been taken away — but I know that … I’ll get there in time to get them back. And after I finish this, I will be on my way home.
I have to thank Miraval again for taking very good care of me and making sure I got good rest.
We don’t get much — we saw an electric show because it was lightening and we saw a rainbow.
I had a very good time here — and if anyone wants to rest I think they should come here.
Because there’s a lot of lies that have been put out there and I am going home to straighten them out and this kind of stuff doesn’t make sense. So I want to say goodbye and I am on my way home.

The actress’ lawyers have reportedly filed for an emergency custody and child support hearing in New York.
The paperwork was filed Tuesday by Katie’s attorney Allan Mayefsky, RadarOnline.com has exclusively learned.

When asked if he would cooperate with Katie Holmes’ lawyers in the divorce proceedings, Rathbun said, “absolutely, I would cooperate. I just want the truth to come out. If I was subpoenaed to be deposed, I wouldn’t fight it and would be cooperative.”
Katie’s lawyer announced Friday that the actress had filed for divorce and that was quickly followed by a statement from Tom’s rep, who said, “Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy.”

Katie Holmes Can’t Use Scientology As Argument To Get Sole Custody Of Suri, Say Attorneys

Katie Holmes can not play the Scientology card in her bid to win sole legal custody of daughter Suri, two top divorce lawyers have told RadarOnline.com exclusively.
As attorneys for the actress and Tom Cruise gear up for one of the biggest divorces in showbiz history, there’s been much speculation in the media about how big a part Scientology played in their marriage and subsequent demise and how it will be used in proceedings.

Top Los Angeles divorce lawyer Grace Jamra tells RadarOnline.com that it would simply be “unconstitutional” for a judge to involve him or herself in issues pertaining to Suri‘s religious upbringing.
“If there are tenets in the religion that spell out certain ways to raise a child and Katie doesn’t feel that’s working for Suri, maybe because she’s acting out a lot, or not doing well in school, or has developmental issues, then that would be what she uses – the litmus test would be what is in the best interest of the child.

“Katie doesn’t really need to use Scientology as the basis or reasoning to get sole custody.”
New York-based family law attorney Bernard Clair concurred, telling us a judge would not consider Tom’s religion and its practices as reason enough to grant Katie full decision-making power over their daughter.
“I am hopeful that a judge would not give too much credence to the fact that someone is a member of a particular religion or particular thought-based organization,” Clair said. “It’s only relevant if it impacts the decision making of the parents.

“If any parent’s religion impacts on that parent’s ability to act in the child’s best interest, then that’s going to be a factor for consideration. But in and of itself, how someone practices religion, should not matter. It is only down to whether a parent interacts with the child positively or negatively. If the religion of the parents causes it to be negative then that needs to be looked at.
“Just the fact that Tom is a Scientologist should not matter,” he adds.
“If I were Katie’s lawyer, I wouldn’t use religion as a factor but if she has particular examples of practices that she may believe to be detrimental to Suri’s wellbeing that Tom uses then I would highlight those before the judge rather than specifically using Scientology.
“The religion itself is of no importance until you can draw a nexus between a person’s conduct that they say derives from the religion and then the secondary nexus, the more important one that such practice is in some way detrimental to the child or not in her best interest.”
The Daily Beast reports that although Katie converted to Scientology in 2005 before she tied the knot with Tom, she hasn’t been seen inside a Scientology Church for quite a while and even enrolled Suri in a Catholic pre-school a few years ago
